Definitions
User – any person who visits the website www.rhinosafety.ro
Customer – natural / legal person placing an Order on the www.rhinosafety.ro website
Products and Services – any product mentioned in the Order to be supplied by the Seller to the Customer.
Order – an electronic document that intervenes as a form of communication between the Seller and the Customer, through which the Customer expresses his intention to purchase certain Products and to make payment for them.
Seller – the company RHINO SAFETY SRL, with the following identification data: registered in the Trade Register with the dates: J04/275/2010, CUI: 26686981, Address: Calea Moldovei 45, Bacău.
Contract – an Order confirmed by the Seller, whereby the Seller agrees to sell and deliver the Products and the Customer agrees to purchase, receive and make payment for such Products and Services.
Courier – any person under public or private law who provides express courier services and with whom RHINO SAFETY SRL has concluded a service contract.
Intellectual property rights
The content of the www.rhinosafety.ro website : images, text, web graphics, scripts, software, design rights, modeling rights, patents, trademarks are entirely the property of RHINO SAFETY SRL and its suppliers and are protected by the Copyright and Related Rights Act and by the laws on intellectual and industrial property. The use without the consent of RHINO SAFETY SRL of any of the elements listed above is punishable according to the legislation in force. www.rhinosafety.ro, the name and the logo are registered trademarks of RHINO SAFETY SRL.
RHINO SAFETY SRL may offer to the User/Customer, by means of an agreement, the right to use, in a described form, certain content of the website. This agreement applies strictly for the defined content(s), for a period of time set out in the agreement and only to the person(s) who have been permitted to use such content(s), without being able to use other content(s) of the www.rhinosafety.ro website.
The use on www.rhinosafety.ro of any trademarked name does not constitute advertising for that company. www.rhinosafety.ro accepts no responsibility and cannot be held liable for any damages arising from the use of the content of the site.

The user uses the site at his/her own risk, www.rhinosafety.ro being free from any liability for any direct or indirect damage caused by the use or access/visitation of the site or as a result of the use of the information on the site. RHINO SAFETY SRL is not responsible for any errors or omissions that may occur in the writing or presentation of the materials on the site.
RHINO SAFETY SRL reserves the right to cancel Orders for Products which are displayed on the website due to technical errors, or which, due to technical errors, show obviously erroneous/ mispriced products.
Any links to other sites are provided solely for the purpose of increased accessibility to information and RHINO SAFETY SRL assumes no responsibility or liability for the content of these sites, or for the products or services promoted or marketed through these sites.
Limiting access to the site
In case of submission or display of materials/documents involving texts, lines, reviews, etc., formulated by Users, it is considered that the User guarantees their originality and grants RHINO SAFETY SRL and its affiliates/associates the unlimited, free, irrevocable and retransferable right to use, reproduce, modify, adapt, publish, translate, create derivative works, as well as the right to distribute, present these contents anywhere in the world, by any means. The User warrants that he/she has all rights to the content that he/she displays or transmits on the site, by any means whatsoever, in such a way that, by using this content, he/she does not cause any harm to any third party physical or legal entity.
Processing of personal data
The categories of personal data processed are: name and surname, telephone/fax, address (home/residence), e-mail, profession, geolocation/traffic data.
When a User creates an account on www.rhinosafety.ro, you will receive commercial communications from RHINO SAFETY SRL only to the extent that you have given your express consent by selecting the appropriate option.
In accordance with Law no. 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, as amended and supplemented and Law no. 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector, RHINO SAFETY SRL is obliged to process in secure conditions and only for the specified purposes the personal data provided by Users.
The purpose of collecting personal data is: economic-financial management, advertising, marketing, publicity, statistics, electronic communication services, informing Customers about the status of their account on www.rhinosafety.ro, informing Customers about the evolution and status of Orders.
The filling in of the forms on the website by the Users is tantamount to the unconditional acceptance that these data will be included in the RHINO SAFETY SRL database.
Users who visit the Website and subscribe to the newsletter or use any other functionality made available through the Website must act in good faith and respect the intellectual property rights of RHINO SAFETY SRL (described in the section above).
Users subscribed to the newsletter have the right to withdraw their consent to registration at any time, through the unsubscribe link/button indicated within each newsletter message they receive by e-mail.
Customers are guaranteed the rights provided for by Law no. 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, namely the right to information, the right of access to data, the right of intervention, the right to object, the right not to be subject to an individual decision, the right to apply to the courts in case of violation of their rights. Customers shall have the right to request erasure of all or part of their personal data. The client may request any of the above listed rights on the basis of a written, signed and dated request submitted to RHINO SAFETY SRL at the email address: marketing@rhinosafety.ro.
Refusal to provide such data shall make it impossible to fulfill the Orders.
RHINO SAFETY SRL does not ask its Users by any means of communication (telephone/e-mail, etc.) for confidential information, bank account data, personal passwords, etc. If the User discloses them to third parties, he/she bears full responsibility for his/her actions. Thus, in cases of disclosure of such data, the User cannot hold RHINO SAFETY SRL liable for any kind of damage.
Not keeping data: The Customer/ User/ Buyer’s payment card data will not be accessible nor stored by RHINO SAFETY SRL, but only by the institution authorizing the Transaction or another entity authorized to provide card identification data storage services, of which the Customer/ User/ Buyer will be informed, prior to data entry.
3D Secure: 3D Secure stands for a new global approach to authenticating buyers and sellers in secure Internet transactions. This security measure involves redirecting the user at checkout to a secure page where each cardholder is registered by assigning an authorization code for each online transaction. The cards accepted for payment are VISA (Classic and Electron) and MASTERCARD (including Maestro, if they have a CVV/CV2 code).
Register as a user
To create an account on www.rhinosafety.ro, the User is obliged to use a valid e-mail address. Authentication on the site can be done through a Site Account. RHINO SAFETY SRL may refuse the application for registration in situations where it finds that information has been used inconsistent with reality or services are used in a manner inconsistent with normal custom.
Price
The final price paid by the Customer consists of the price of the product plus the shipping charges related to the order. Delivery costs are detailed in the Delivery Policy.
All prices of products sold through the website www.rhinosafety.ro are expressed in Lei and include 19% VAT.
Order
By finalizing the Order, the Customer guarantees that all data provided is true and correct, otherwise he/she may suffer the consequences of these errors (delayed Order, wrongly transmitted, etc.).
RHINO SAFETY SRL cannot be held liable for erroneously entered information, which may result in delivery delays. In this context, all transportation charges incurred in order to reship the Order shall be borne by the Customer.
By finalizing the Order, the Customer agrees that a RHINO SAFETY SRL representative will contact him/her by any available means agreed by the Parties (e-mail/telephone) for personal confirmation of the Order.
The placing of the order is not a final confirmation of physical stock availability, and the Rhino Safety team will check product availability and contact the customer in case of stock discrepancies. If the products in the order are physically in stock, the order will automatically go into preparation and a firm delivery date will be communicated to the customer as soon as possible.
Although RHINO SAFETY SRL has taken all measures to ensure that the information presented on this website is accurate and correct, RHINO SAFETY SRL cannot be held responsible for any inaccuracies that may occur in the Customer’s completion of the forms on the website for the finalization of the Order. Users are responsible for evaluating the accuracy and usefulness of the information provided in the forms available on this site.
The contract is considered concluded between the Client and RHINO SAFETY SRL when the Client receives from RHINO SAFETY SRL, by electronic mail and / or SMS notification of dispatch of the Order.
If a Good and/or Service ordered by the Client cannot be delivered by RHINO SAFETY SRL, we are obliged to inform the Client of this fact and to return to the Client’s account the amount of the Good and/or Service within 14 days from the date on which RHINO SAFETY SRL became aware of this fact or from the date on which the Client expressly expressed his intention to terminate the Contract.
Billing – payments
The price, payment method and payment term are specified in the Order. The Seller will issue to the Customer an electronic invoice for the Products and Services delivered, the Customer’s obligation being to provide all the information necessary to issue the invoice in accordance with the legislation in force.
Payment can be made online (bank card) or by refund.
Delivery
The estimated delivery date may vary depending on the product.
For products in stock, delivery will be made according to the Customer’s option, by Sameday Courier or Sameday EasyBox (options available on the checkout page).
If the order has been finalized by 14:00, the shipment will be made that day. Orders placed after 15:00 will be processed the next day and delivered the following day, with the products reaching the customer within 48 hours from the moment the order is finalized.
If the Customer exercises the right to unilateral termination of the contract within 14 days of receipt of the products, the cost of returning the products shall be borne by the Customer.
Delivery conditions
At the request of RHINO SAFETY SRL or of the Courier, the Customer shall prove his identity, if necessary by one or more documents issued by official authorities and shall communicate the Order number assigned by the Seller.
If the Customer is unable to receive the Order in person, the Order will be left at the specified address only to a person over 18 years of age and only in case of communication to the Courier, the Order number.
No request for delivery of an Order can be honored if the Customer does not meet the above conditions.
In the case of delivery to the Customer’s place of work, in which case the Courier cannot have access to that location, the Customer must ensure that he can receive this Order.
The Customer will be contacted by telephone by the Courier in advance to obtain confirmation of its presence at the address selected when validating the Order on the website.
The customer is obliged to be present at the delivery address indicated, during the selected delivery time, otherwise he/she will be charged the transportation fee for a possible new delivery. The time interval can only be changed, after the selection, with the Courier’s agreement.
Delivery is considered to be fulfilled by RHINO SAFETY SRL, at the time of delivery of the ordered products to the Customer at the address selected by him when placing the Order.
Suppliers
RHINO SAFETY SRL has equipment distribution contracts with manufacturers/importers of the brands present on the site. The suppliers guarantee the ownership of all sales rights on the Romanian territory, the quality of the products, the authenticity of the brands. RHINO SAFETY SRL has the legal acceptance of its suppliers to publish on the site presentation videos and images, logos and product specifications.
Product guarantee
All goods commercialized by RHINO SAFETY SRL benefit from warranty conditions in accordance with the legislation in force and the commercial policies of the manufacturers. The goods are new, in original packaging and come from authorized sources.
Warranties can be sent either with the products in the parcel or electronically after delivery of the goods. In either case, the guarantee is valid from the date of delivery.
If the warranty has not been transmitted to you either physically or electronically within 48 (forty-eight) hours of delivery, please notify us by email at: marketing@rhinosafety.ro.
In the case of warranty certificates issued by manufacturers or importers, the Goods claimed to be defective within the warranty period must be returned in the original box, together with all accessories received and a copy of the invoice. Missing or damaged labels, markings on the products may result in the return claim being refused.
All transportation costs will initially be borne by the customer, including in the event of non-acceptance of return or replacement.
No returns will be accepted within 14 calendar days if the products show signs of wear and cannot be resold.
Reimbursement of the value of returned products will be made within 14 (fourteen) calendar days of receipt of the products, as follows:
- for orders paid by credit card ->by refund to the account from which the order was made
- for orders paid by cash on delivery -> by bank transfer to the account mentioned by the buyer in the return request sent.
The cost of return transportation is borne by the customer.
Products sold on our website benefit from the legal guarantee of conformity.
Force majeure
Neither of the contractual parties can be held liable for non-performance (total/partial) or late performance of its obligations, if these were caused by force majeure. The parties shall immediately inform each other of the force majeure event and take all necessary measures to limit the consequences of the event.
If the event of force majeure does not cease within 15 days, the parties have the right to unilaterally terminate the contract without claiming damages.
Force majeure will be proven in accordance with the law.
Applicable law
The contract shall be governed and interpreted in accordance with Romanian law. Any conflict arising between RHINO SAFETY SRL and Clients will be resolved amicably. If this is not possible, the first means of settlement is mediation, under the conditions of the law, and if this fails, the competent Romanian courts of the Customer’s domicile shall be resorted to.
Fraud
The creation of multiple accounts using such automatically generated addresses that expire after a predefined period in order to benefit from promotions or offers, or any fraudulent behavior that may affect the smooth running of campaigns, is prohibited and will be considered an attempt to defraud. The owner of the https://rhinosafety.ro website reserves the right to suspend the accounts thus created and to withdraw the benefits related to the promotions or offers in progress, to cancel the account without notice, notification, other formalities or compensation.
Any attempt of fraud or any fraud (such as but not limited to: accessing RHINO SAFETY SRL Clients’ data, altering the content of the site, attempting to affect the performance of RHINO SAFETY SRL servers, diverting the content of deliveries to third parties, etc.) will be punishable under criminal law.
Final provisions
If any of the above clauses is found to be null and void or invalid, this will not affect the validity of the remaining clauses.
